All new and existing contractors and their workers will need to: -

  • Undertake a company WHS Induction Course prior to commencing work on site.
  • And from time to time attend training or information sessions organised by the company.

  • The information contained in this course should not be substituted for specific legal advice, but is provided as guidance to enable us both to manage our work health and safety (WHS) in a systematic manner.
  • Your business may need to develop additional information, which takes into account your circumstances specific to site conditions, trade interface, client requirements and your individual company policies and procedures.
  • It is condition of entry to our company sites that these safety requirements are adhered with.
  • All Acts, Regulations and Codes of Practice having jurisdiction over your work MUST be followed and adhered to at all times.
Non-adherence to company safety rules maybe a serious breach of your contract with our business and the relationship may be terminated if serious breaches are not rectified or continue.


The WHS Act defines your employees and subcontractors as workers, as such it makes it impossible to dilute your work health & safety responsibilities by using subcontractors as they become your workers with this in mind we would like to remind you of our subcontracting policy, which states our company requires all workers to be inducted in to our WHS management plan for our construction sites.

Purchasing/ Procurement: (Materials Goods & Services)

It is the obligation of the Principal Contractor that all materials, equipment and plant purchased or hired must conform to the relevant WHS legislation and Australian Standards.

All relevant WHS compliance documentation should then be collected and approved before signing contracts for the supply of materials goods and services to the construction site.

A valid licence is essential before any work is undertaken on any of our sites.

These documents will be requested prior to undertaking any work on our sites and may be requested when we or others undertake WHS audits or when investigating incidents on site.

Please note: A WorkCover Inspector may also ask for proof of competence.

Safe Work Method Statement (SWMS) for your specific trade activity

You are required to supply a copy of your completed Safe Work Method Statement (SWMS)  or

  • Job Safety Analysis (JSA) or
  • Safe Operating Procedure (SOP) or
  • Safe Work Procedure (SWP)

These documents must be reviewed periodically and therefore dated less than 12 months old.

The principal contractor will provide a set of high risk SWMS applicable to the risk activity; please read, review or adjust the principal contractors high risk SWMS and sign off as adopted by your business.

Safe Work Method Statements (SWMS) for high risk construction work

A SWMS is a written document that sets out the high risk construction work activities to be carried out at a workplace, the hazards and risks arising from these activities and the measures to be put in place to control the risks. Its primary purpose is to help supervisors and workers implement and monitor the control measures established at the workplace to ensure high risk construction work is carried out safely.

High Risk work includes but is not limited to the following examples: -

  • involves a risk of a person falling more than 2 metres, or
  • involves, or is likely to involve, the disturbance of asbestos, or
  • involves structural alterations or repairs that require temporary support to prevent collapse, or
  • is carried out in or near a confined space, or
  • is carried out in or near a trench with an excavated depth greater than 1.5 metres,
  • is carried out on or near pressurised gas distribution mains or piping, or
  • is carried out on or near energised electrical installations or services, or
  • is carried out on, in or adjacent to a road, railway, shipping lane or other traffic corridor that is in use by traffic other than pedestrians, or
  • is carried out in an area at a workplace in which there is any movement of powered mobile plant.


The SWMS must be specific to the work activity and include any hazards and the relevant controls required.

Contractors MUST ensure the following SWMS criteria are put in to place: -

  • Submit and agree the SWMS prior to commencing work at Principal Contractor site.
  • Ensure ALL employees have read, understood the SWMS
  • Follow the safe work procedures in accordance with their submitted SWMS
  • Any aspects or risks not covered in the SWMS must be included in your SSRA
  • ALL WHS compliance documentation must be forwarded in a timely manner on request; failure to supply will cause delays in processing payments & issuing work orders.

It is a WHS legal requirement that the Principal Contractor has a copy of their contractors SWMS and they agree with the content and safety outcomes required to conduct a safe build process effectively in line with their risk management processes.

Please be advised these documents should be readily available on site along with any applicable chemical Safety Data Sheets (SDS’s).

Typical hazards on residential construction sites can include but not limited to working at heights, working on or near mobile plant & equipment, gas and or electricity mains, trenches pits & excavations; traffic vehicle & pedestrians – overhead power lines.

All Contractors MUST apply a Duty of Care and accountability by carrying out a written Site Specific Risk Assessment (SSRA) of their workplace, prior to undertaking their work activity to identify any hazards that may affect safety on site and where necessary arrange for the appropriate safety control measures to be put in place.

  • If you require help or assistance in understanding & completing your risk assessment – contact your local site supervisor.
  • SSRA’s must also be dated & timed and a copy forwarded with your invoices.

If serious risks are still present contact the site supervisor or business office to inform them what the issues are and await instructions before proceeding.

Please Note: -Site Supervisors & Internal / External Auditors will ask to see your SSRA to see if it has been completed correctly failure to complete an SSRA may result in a Non-Compliance Notice being issued or you may be asked to leave the site.

When should SSRA’s be completed?

  • before work starts
  • prior to sending your invoice

WHS management plan

  • All construction projects (construction work costing $250,000 or more) must have a written WHS management plan prepared by the principal contractor before work on the construction project commences.
  • A WHS management plan is a written plan that sets out the arrangements for managing some site health and safety matters. The intention of a WHS management plan is to ensure the required processes are in place to manage the risks associated with a complex construction project, as there are usually many contractors and subcontractors involved and circumstances can change quickly from day to day.

Informing people about the WHS management plan:

The principal contractor must ensure, so far as is reasonably practicable, that all persons who are to carry out construction work on the construction project are made aware of the content of the WHS management plan in respect to their work and their right to inspect the plan. The principal contractor may do this by:

  • giving subcontractors a copy of the plan with a requirement to make their workers aware of the contents of the plan that are applicable to their work, prior to commencing work on site, and checking to make sure this is done
  • displaying the plan on site on a sign or a sticker
  • Other arrangements - on Site Safety Signage?

Site safety signage

Site safety sign which can be found on the site security fence normally at the front of the site contains valuable safety information including site safety rules, emergency contact details applicable to this site & what you need to do in the event of an emergency.

Site Safety signage is for the information of all workers on site and the local community. It is important you do not interfere, remove, cover or impair view of signage.

Pay attention to and heed all safety warning signs – they are there for your protection.

Construction site security and fencing

General site access and egress shall be established in a manner that is safe and without the potential of endangering workers working on the site or the nearby public. There is an obligation to report any unauthorised entry to the Site Supervisor/ Principal Contractor.

Trades who leave gates or fencing panels open or unsecured will be back charged for the fence rectification

  • Gates are to remain closed and locked at all times as per company policy.
  • Fencing panels if removed for access; MUST be laid flat and not in the propped up position for safety reasons and reinstated once work is complete.

Why is it important to secure the site security fencing at the end of each working day?

  • to prevent unauthorised access

Personal protective equipment (PPE)

All PPE used on site MUST be appropriate to the task and must comply with the appropriate Australian Standard and should be in good condition.

When required, all workers MUST wear the necessary PPE to conform to the requirements of their Safe Work Method Statement for the work activity task to be undertaken.

Safety equipment including gloves, safety goggles, helmets and earmuffs should be available from your employer for your protection. 

  • Workers need to be trained in adequate use and maintenance of PPE
  • Safety footwear is mandatory on all residential construction sites

When should personal protective equipment (PPE) be used?

  • as prescribed in your SWMS
  • as or when you feel it is required

UV protection (SUN SMART POLICY)

All workers should wear the appropriate UV protection, where and when required.

  • Sunscreen MUST be a ‘broad spectrum’ water resistant sunscreen with a minimum sun protective factor of (SPF) 30+
  • Sun protective work clothing should be loose fitting and long-sleeved with collars, long trousers.
  • A hat or appropriate headgear should shade your head, Face, neck and ears – Broad brimmed hats are recommended.
  • Check your skin, especially those parts most exposed to the sun. Report any skin changes to your doctor and request that they are examined.

Do not forget to hydrate yourself regularly drinking water or a suitable hydrate fluid not fizzy type drinks!

  • Maintain a good fluid intake by taking small, frequent drinks of water.

Electrical tools & equipment

All electrical equipment must when in use, be protected by residual current devices (RCDs). All electrical equipment must be well maintained, fully serviceable and inspected and tested at three monthly intervals by an electrician or suitably qualified person. A tagging system must be used and test results should be recorded in a register by the electrician or suitably qualified person.

All electrical extension leads shall be of heavy-duty type and not extended over 35 metres from the power source.   Power leads are not to be run over roadways; footpaths or areas where members of the public may trip.  Power on an adjacent house or block is not to be used unless express permission of the occupier is obtained.  Obtaining power without permission is theft.

All RCD protection (portable and fixed power boards) shall be tested on a 3 monthly basis and comply with the Industry Standard.

Double adaptors, domestic power boards and 3 pin plug adaptors (piggy-back) shall not be used on site. These can generally be identified by their white colour.

Portable Generators:

All generators must be fitted with RCD protection and weatherproof power outlets. Generators must only be operated in well-ventilated area.

  • Socket outlets (SO) MUST include residual current devices (RCDs) for the protection of electrical shock to all electrical devices connected to the general power outlets.
  • Electrical Power isolations E-locks, Lockout or Danger Tags are not to be removed unless authorised to do so.

Please refer to AS/NZS 3012 for further guidance.

How often should leads be tagged?

  • 3 monthly
  • 6 monthly

All ladders MUST conform to the Australian Standard and be of industrial grade and rated no less than 120kgs. Ladders should be maintained in a sound working condition.

Single or extension ladders may only be used to gain access or carry out permitted work where:

  1. The material or equipment being carried does not restrict movement or cause loss of balance;
  2. The trunk of the body remains centred on the ladder; and
  3. Equipment can be used with one hand (unless a control to prevent a fall is used).


Correct selection of an appropriate type of stepladder is the key for ensuring safety during use.

  • Stepladders should only be used in the fully opened and locked position.
  • All components must be in a good serviceable working order.
  • A person’s feet should be no higher than the second tread from the top step.
  • A stepladder shall not be used near the edge of an open floor or penetration where, if the ladder toppled, a person could fall over the edge or through a penetration.

Trestle Ladder Platform Systems:

Platforms used on trestle ladders below two metres for construction work must be 450 mm wide unless the work is light work.

Examples of light work include:

  • Painting, installing a roof gutter, air-conditioning duct, metal fascia or lighting
  • Performing inspections or tests
  • Installing an electrical connection

Fixing plasterboard sheeting to an internal stairwell void, fixing cladding to a gable end of a roof  or using a medium or heavy duty angle grinder or circular saw are not considered light work.

For work construction on a trestle ladder over 2m (two) metres in addition to above:

  • Trestle system must have installed handrails, intermediates and kickboards along outer length of the platform
  • The gap between the inner edge of the platform and face of a building/structure is not greater than 225 mm
  • Each trestle ladder must be secured to prevent it moving via an approved method in line with the designers & manufacturer’s specifications and instructions.


  • Trestles should only be used below 2m unless designed tested, registered & approved.
  • If you use these systems you will be challenged to provide the relevant documented evidence.

What grade of ladder should be used?

  • industrial grade - rated no less than 120kgs
  • 100kgs

Scaffolding & working at heights

Any person having to perform works at and above 2 metres MUST be supplied with a perimeter safety rail system, scaffold, or other approved fall arrest system.

  • A licensed/competent scaffolder MUST erect scaffold over 4 metres.
  • All scaffolds MUST be erected to conform to the Australian Standards and manufacturers/suppliers specifications.
  • Never remove guard-rails, planks, brick guards, handrails or Toe boards/ Kickboards for any reason. 
  • If scaffolding needs to be altered, speak to the Site Supervisor.
All scaffolding MUST be loaded as per the LOAD Specification identified on the “SCAFF-TAG” or Scaffold Access Control System (“SACS”) card located at the scaffold ladder access bay. If the scaffold is rendered UNSAFE or INCOMPLETE remove the “SCAFF-TAG” or “SACS” insert to reveal the “DO NOT USE SCAFFOLD” and contact the Site Supervisor immediately.

STAIRVOID PROTECTION SYSTEM & GUARDRAILS: Altering safety systems prohibited

Stair-void Protection System & Guardrails MUST remain in place at all times when persons are working on the upper level.

At NO time is the Stair-void Protection System hatch to be left open; all components MUST be reinstated if they are removed.

If the Stair-void Protection System or any part of the Stair-void Protection System is NOT installed then no access to the 1st floor is permitted and the Site Supervisor MUST be contacted IMMEDIATELY!!

If there are issues in reinstating the stair- void system or guardrails who must you call?

Working Alone: Legal Obligation to Worker

Alone or isolated workers should communicate to their nominated contact person/s as to their planned actions for the day e.g. SMS when arriving on site and when leaving.

  • We can assist you if we know where you are.
  • If you are delayed due to weather events let your family know where you are by keeping them informed.
  • Communication is important to ensure your safety on site & ensure your safe return.

Excavations & Underground Services

Dial 1100 Before You Dig is the law

Ensure this information is considered in planning the work and decide on and use control measures to prevent people being exposed to the risk of death, illness or injury from coming in contact with, or damage to, the service.

Before excavation work starts, each relevant subcontractor must:

(a) Find out what underground services exist at or near the location of the excavation
(b) Obtain relevant information about the service (location, type, depth, restrictions to be followed) from the appropriate source DBYD 1100
(c) Record the information in writing
(d) Keep the information recorded until the construction work ends.

Before commencing any excavation on a residential construction site, the underground power plan in the local meter box must be inspected.

Excavations, Penetrations & Floor Openings - Falls

Each PCBU is responsible for ensuring any trenches or holes they create are made safe using suitable means.

  • All excavations 1.5 metre or more deep SHOULD be shored or battered.

Floor openings and excavations are to be adequately guarded or barricaded or otherwise protected to prevent someone falling.

  • If a safety barrier has to be removed for work, make sure it is replaced again before you leave the area.

Dangerous Protrusions – Impaling Aspects

Star pickets & reinforcement bars, nails or other protruding objects e.g. copper pipes etc. that protrude from surfaces should be made safe. Yellow plastic caps are not a protection for impalement.  If there is a risk of anyone falling onto reo bar or star pickets, the area must be barricaded off.

Who’s responsibility is it to ensure Dial Before You Dig (DBYD) process is undertaken before digging on site?

  • every PCBU who breaks the surface i.e. trenches & holes etc.

Contractors are responsible for ensuring any trenches or holes they create are made safe using suitable means. All excavations in excess of 1 metre or more deep MUST be shored or battered. All star pickets/impaling posts MUST be covered by Yellow Caps. Floor openings and excavations are to be adequately guarded or barricaded or otherwise protected to prevent someone falling. If a barrier has to be removed for work, make sure it is replaced again before you leave the area.

Workplace Hazardous Substances

All contractors MUST maintain a register of all hazardous substance that is used on site. The Register MUST contain a relevant and up to date Safety Data Sheets (SDS) for each of the hazardous substances used.

No hazardous substances are allowed to be stored on site without permission and must be removed by the trade contractor at the end of their working day. PC is to be notified what hazardous substance is on site.

Workplace bullying, harassment, violence or discrimination

Under both federal and state laws it is unlawful to discriminate against people at work or in a work related environment.  Bullying, which includes behaviour that intimidates, offends, degrades, insults or humiliates a person, whether physically or psychologically, is a form of harassment and will not be tolerated on any construction site.  Persons found to be bullying other persons will, at the discretion of the Principal Contractor, be required to leave the site.

The Principal Contractor under any circumstances will NOT tolerate “Workplace Bullying or Workplace Violence”.  If any such instances occur please contact the Site Supervisor IMMEDIATELY or telephone WHS Emergency Site Response number found on the site safety signage.

Workplace bullying, harassment, violence or discrimination – if you witness this what do you do?

  • turn a blind eye
  • report it to your site supervisor

Alcohol & drugs

Consumption of alcohol or the taking of illicit drugs is forbidden on all construction sites.

Anyone found to be under the influence of drugs or alcohol or considered not fit for work duties will be requested to leave site.

Persons following a prescriptive course of drugs should not operate any plant or machinery or carry out any other tasks if the side effect of the drugs impairs their judgement or ability to carry out these tasks safely.

It is important to remember that some prescription drugs can have side effects such as drowsiness. Check medicine labels for any warnings and let your supervisor know if you are taking any medication with a possible side effect.

  • If you identify any discarded hypodermic needles on site you MUST ensure they are safely disposed of and contact the Site Supervisor to report your findings.

Environmental & safety Issues

To promote good environmental practice and awareness across a site, the following are examples that can be implemented. The Principal Contractor should provide instruction and advice to all PCBU’s and workers in order to facilitate good environmental outcomes. These environmental workplace rules should apply equally to ever person working on the site.

Workplace Environmental Management

  • Access to dangerous areas of the workplace shall be restricted and warning signs posted
  • Temporary lighting shall not be directed into adjacent properties
  • Clean up all wastes and place them in the dedicated bins provided
  • Roads must remain clear of mud, litter, building rubble and waste.

Hazardous Substance Spills

  • Any spills of chemical, paint or fuels must be reported immediately

Soils Stockpiles

  • Stockpiles must not be placed near stormwater drains, grates or drainage ditches
  • Batter stockpiles to 2:1 (horizontal to vertical) or less
  • Prevent flow of stormwater from stockpiles into drains with stabilisation or sediment fences.
  • Long term stockpiles must be stabilised
  • Contaminated soils must be placed in areas defined by the principal contractor


  • Use silt fences or other barriers to remove excess dirt/sediments from stormwater
  • Fix or replace any damaged silt fences or barriers


  • Place ALL separated clean paper, cans and bottles in dedicated recycling bins
  • Concrete wash out is not allowed on site and any residue is to be taken away by the agitator operator
  • Waste paint (solid) paint containers, chemical containers render, render containers should be removed from the site at the end of the day.
  • Advise your site supervisor of any odorous solids/soils excavated at the workplace

Dust, Smoke and Odours

  • Keep exposed soil and roads moist so that they do not generate excessive dust
  • Do not drive vehicles on unsealed areas or off the established roads & tracks unless it is absolutely necessary
  • Park vehicles in designated areas ONLY
  • Remove excess soil from wheels and vehicle bodies before leaving the site


Maintain plant and equipment regularly and fit with manufacturers specified noise silencers. Noisy activities must be discussed and approved by Principal Contractor prior to starting activities

Chemicals Spill and Disposal

All Hazardous substances (chemical) and Dangerous Goods must NOT be stored on site

  • No smoking within 10 metres of any flammable goods/chemicals
  • DO NOT put chemicals or chemical containers in general purpose bins
  • DO NOT put chemicals in stormwater drains or the sewer
  • Immediately clean up any spills
  • Trades must notify Principal Contractor management immediately of any substantial or dangerous chemical spill.
  • Ensure clean up and disposal of Hazardous Substances are in accordance with the requirements in the MSDS’s and ensure that appropriate PPE is made available and worn.
Additional requirements such as environmental protection should be considered.

If an Emergency occurs on a MJH Group site, contact the Site Supervisor IMMEDIATELY or telephone WHS Emergency Site Response No 0400 664 300

This number is also displayed on the Site Safety Signage located on the front site security fence.

Contractors (PCBU’s) MUST ensure that they have a suitable sized “First Aid Kit” which is applicable to their work activity vs. risk i.e. amputation (bags).

All Site Supervisors are trained in first aid and have a first aid kit at their disposal for use in the event of an incident.


  1. WHERE the emergency is : give the address/name of the site and details about the specifics of entry
  2. WHAT has happened : advise the exact nature of the injury
  3. WHAT is being done
  4. WHO is calling : leave a site or contact telephone number
  5. WAIT to be told what to do before hanging up

Whilst waiting for the authorities, keep calm, do not interfere with the accident scene and make sure the injured person is not moved; unless there is a risk of further injury to the patient or others. Reassure the injured person that help is on the way.

Assist the authorities to locate and access the accident site.

In the event of an emergency on-site immediately alert all other contractors in the immediate area of danger to evacuate to a safe area, normally the entrance gate to the construction site or a safe distance away from danger, and advise the Site Supervisor/Principal Contractor of the situation. If necessary call the relevant emergency services

In the event of a fire or evacuation what must you do?

  • advise the site supervisor of the situation
  • if necessary call the relevant emergency services


All incidents which may have resulted in an injury should be reported to your Site Supervisor immediately who will determine whether it is a notifiable incident. The trades must cooperate with principal contractors’ representatives to ensure that the incident is properly investigated so that controls can be put in place to stop reoccurrence of an injury or incident. In the event of a Notifiable Incident serious injury or emergency, requiring urgent medical attention, ring 000 for immediate assistance.  The Site Manager must be notified at the earliest opportunity.

An incident report form is a short and brief report consisting of the basic facts known at that time; to be communicated to management and or WorkCover. Additionally, circulation of this document frees up valuable communication line/s to assist with advice and instruction during the emergency incident / situation. It also helps with the following:

  • Ensures Senior Management are notified to assist and enable relevant resources to be put in place
  • Provide initial help & assistance to ensure safety of injured persons
  • Provide support & manpower where required
  • Provide relevant advice to secure site & evidence

An example of how to Categorise an incident

  • Class 1 - Serious – WorkCover Notification
  • Class 1 - Plant & Equipment – WorkCover Notification

Note: Both are known as scenes to preserve

  • Class 2 - Medical Treatment Required
  • Class 3 - Incident No Treatment Required
  • Class 3 - Damage to Property
  • Class 3 - Involving a Member of the Public

When an Accident, Incident or Near Miss has occurred on site, this MUST be reported immediately to the Site Supervisor. This will allow an Investigation to document all details and facts as soon as possible after the event to ensure preventative measures are put in place.

This will assist in addressing all safety aspects for the future and prevent reoccurrences.

When should incidents be reported?

  • within 24 hours
  • as soon as possible i.e. 30 minutes

The aim of this section is to make sure that workers are familiar with the WHS rules and procedures of the site relating to NON COMPLIANCE. (copy)


Where a matter of WHS Non-Compliance of products, materials, equipment or work practices is identified by a construction supervisor through regular Daily Site Safety Inspection procedures a Site Instruction / “Non-Compliance Notice” will be issued; detailing the area of non-compliance and corrective actions required.

If issued to trade / contractor they must complete and return the corrective actions slip to MJH Group to verify the agreed corrective actions have been completed by the due date.

Copies of these records will be kept on their contractor vendor file for future reference.

Repeat Offenders
Failure to effect an improvement after issue of this notice, will lead to a review by the Construction Manager and/or the WHS Manager. Where a person or a sub-contractor is in continuous breach of safety or quality standards, or a Site instruction is not complied with in a pre-determined time frame, cancellation of the person or sub-contractors contract, may result.
